Gambling laws in Indiana are laid out in the Indiana Code sections 35-45-5-1 and 4-31-1-1, with gambling defined in the state as "risking money or other property for gain, contingent upon lot, chance, or the operation of a gambling device."

This means that everything that could fall under the broad definition of gambling is deemed illegal unless otherwise specified. The Indiana Gaming Division regulates gambling in the state. Here's a look at what Indiana's laws mean about each type of gambling activity.

Casino Games

Casino gambling is legal in Indiana. The practice began in 1993 when legislation was passed to allow riverboat casinos, with land-based casinos legally permitted from 2015. Venues available in Indiana include six riverboats, four land-based casinos, two racinos and one tribal casino. Between them, these venues offer the full range of casino games, including slots, table games and bingo.

Online casino gaming is still illegal in Indiana, with the state being one of only a few that specifically mentions online gambling in its legislation. Despite this, many offshore online casinos accept players from Indiana, with Hoosiers easily able to play online casino slots and other such games via these sites. Although this is technically illegal, authorities in the state show little interest in prosecuting players, and there are no records of such prosecutions to date.

Poker

Land-based poker is legal in Indiana, but only via one of the licensed venues, which includes the larger casinos and a few charitable organizations' poker rooms. Playing real money poker games at unlicensed venues, including private residences, is illegal.

Online poker gambling is illegal in Indiana, with the state not permitting card games, whether they are classed as games of chance or skill (technically, all card games are deemed games of chance in Indiana). That doesn't stop the numerous poker sites from accepting residents of Indiana, but there's little chance of facing prosecution for playing at such sites.

Bingo

Bingo gambling is legal in Indiana, but only at licensed venues or permitted charitable events. Online bingo gambling is illegal in the state, but residents can easily play games via the numerous available bingo casinos online without fear of prosecution.

Lotteries

Lottery gambling has been legal in Indiana since 1988 after residents voted to overturn a ban in 1851. Today, state residents can buy draw tickets for local and national lottery games, scratch cards and instant games at any Hoosier Lottery retailer. Although the lottery operator has a website, online ticket sales are prohibited in the state. Residents wishing to play online lottery games can find many opportunities via foreign lottery casino sites.

Any form of social gambling involving real money gameplay that takes place outside of licensed premises is deemed illegal in Indiana. That means even home-based games of poker are not permitted. Lootboxes and skins gambling are unregulated in Indiana, but both could be construed as forms of gambling under existing legislation.

Regarding cryptocurrencies, Indiana recognizes that virtual coins hold monetary value, but they are not deemed legal tender in the state, so no business is permitted to accept them. Those wishing to play Bitcoin games or gamble with altcoins can do so via numerous crypto casinos.

Indiana's gambling laws date back to 1851, when a ban on lotteries was implemented, which many considered a ban on gambling in general. The ban was finally lifted, and the Hoosier Lottery launched in 1988 after a constitutional vote.

Parimutuel horse racing betting was legalized in 1989, and riverboat casinos were legally permitted from 1993. New laws passed in 2015 expanded upon existing casino legislation to allow the building of land-based casinos in Indiana. 2019 saw the legalization of online and offline sports betting in the state.
