Louisiana gambling laws are detailed in Louisiana Revised Statutes, sections 14:90 and 27, and work on the basis that gambling is deemed illegal unless otherwise specified. In practice, most forms of gambling are legal and provided for in the state, except most forms of online gambling. The state's regulatory body is the Louisiana Gaming Control Board.Here's a look at how Louisiana's gambling laws affect each type of gambling activity.

Casino Games

Casino gambling is legal in Louisiana, with the state home to 24 casinos. Most of these are riverboat casinos, which operate along the Mississippi River. Still, four race tracks also feature casino-style games (called racinos) and one land-based casino, Harrah's New Orleans. Many of the riverboats are in the process of setting up permanent venues on land after changes to the law in 2018 permitted them to do so.

Louisiana laws on online gambling are much more strict than their land-based counterparts. It is one of the only states in the country to outlaw online gambling specifically. Online casino gambling is illegal in Louisiana.

However, there is some debate over the interpretation of the law, with many claiming it only extends to operators of online gambling sites and their immediate employees rather than players themselves. If you're a resident of Louisiana and fancy playing online casino slots or other games at online sites, remember that it is technically considered illegal. However, no players have ever been prosecuted for doing so.

Poker

Land-based poker gambling is legal in Louisiana, with many existing casinos offering the game within their multi-table poker rooms. Home-based poker games are also permitted within the state if no commercial profiting occurs. Video poker machines are also very common in Louisiana, mostly because the licence for such machines is granted alongside alcohol licences. As such, these machines are commonly found in bars and restaurants, truck stops and some shops.

Online poker gambling is illegal in Louisiana, with the state expressly forbidding the operation of such sites within its borders. Many poker sites do accept players from Louisiana despite the laws. The operators themselves are generally much more likely to face prosecution than players.

Bingo

Bingo gambling is legal in Louisiana, but only in games offered by charitable organizations. Online bingo gambling is illegal in Louisiana, as is in general, although many online bingo casinos accept new members from the state. As with most other forms of online gambling here, the operators are usually targeted by the authorities rather than the players.

Lotteries

Lottery gambling is legal in Louisiana, with the Louisiana Lottery launching in 1991. State residents can buy tickets at participating retailers and automated WinStations machines for local and national draws, including Mega Millions and Powerball, plus scratch cards.

Online lottery gambling is illegal in Louisiana. The Louisiana Lottery operates a website, but it is purely for informational purposes, such as checking results. Those wishing to play online lottery games for real money can do so at the various lottery sites that accept players from Louisiana, but it is technically classed as illegal.

Social gambling games within private residences are permitted if there is no profit beyond player winnings. Modern forms of what could be interpreted as gambling, such as loot boxes and skins gambling, are still the subject of much debate across the US, with the activities as yet unregulated in Louisiana.

Sports betting is legal in both online and offline forms in Louisiana. 55 out of the 64 parishes in the state voted to approve the legalization of the activity in late 2020, meaning geolocation tools work on a parish-by-parish basis, preventing access to those located in the remaining nine parishes. Online sports betting markets are also permitted to be offered by up to 41 operators in the state, with the top sites including FanDuel and Caesars.

Similar to sports betting, the legalization of daily fantasy sports was approved in 47 parishes in late 2018, with geolocation technology preventing access to those in the remaining parishes.

The Louisiana gambling age is 18 years old for parimutuel betting and bingo. Still, residents must be at least 21 to participate in state lottery games, casino games and sports betting.

Tax Regulation

Louisiana gambling tax regulation requires land-based sports betting operators to pay a 10% tax and online sports betting operators to pay a 15% tax. For players, gambling winnings are considered income, with the state charging a 6% income tax, while a 24% withholding tax is charged on a federal level.

Gambling in Louisiana dates back to the 1750s when the government operated a lottery. When Louisiana joined the United States in 1812, it had the highest number of casinos compared to the others. This became troublesome for the government, which outlawed casinos the following year. Only casinos located in New Orleans continued operating, but even these were closed after an outright ban in 1866.

The same year, the government launched a state-wide lottery, which became very popular. Even those residents outside the state were allowed to purchase tickets. Congress deemed this illegal in 1890, and the program was shut down in 1893. 1923 saw horse racing betting legalized in the state, and ten years later, both lottery gambling and casino gambling (on riverboats) were reinstated.

Today's Louisiana Lottery was launched in 1991. In 2018, riverboats were permitted to open land-based venues and daily fantasy sports contests were legalized. Both online and offline sports betting was legalized in 2020.
